Reference #: 4375613 THE POSITION Are you a self-motivated, detail-oriented attorney with an interest in utility law? If so, the Pennsylvania Public Utility Commission's Bureau of Investigation and Enforcement (I&E) is looking for prosecutors interested in a career in litigation that enjoy working in a team-based environment. Positions are available in both the Rates Division and the Enforcement Division.

In the Rates Division, the Assistant Counsel (AC2) represents the public interest in ratemaking matters before PUC Administrative Law Judges by analyzing written documents such as rate filings, interrogatories and testimony, coordinating a team of technical staff, and preparing briefs, memoranda, and relevant correspondence.

In the Enforcement Division, responsibilities include the review of formal and/or informal investigations and other pertinent documents referred to I&E to determine and implement the appropriate enforcement action in all prosecutory matters other than rate cases involving any utility areas for violations of the Public Utility Code and the Code of Federal Regulations, among others, before PUC Administrative Law Judges and mediators.

DESCRIPTION OF WORK

In this position, you will serve as Assistant Counsel 2 for the Bureau of Investigation's (I&E) Rates or Enforcement Division in proceedings before PUC Administrative Law Judges, having responsibility for:

Rates Division Analyzing written documents such as rate filings, interrogatories, and testimony Coordinating a team of technical staff, and preparing briefs, memoranda, and relevant correspondence Responsible for developing a prosecutory strategy for discovery, testimony, cross-examination, and settlement negotiations as a lead attorney in rate filings under one million dollars and under the guidance of a senior attorney in rate filings over one million dollars Preparing research, analysis, and recommendations on a variety of issues involving formal and informal investigations, administrative procedures, evidence, and trial practice Working independently or with co-counsel to evaluate the relative merits of legal positions and to subsequently prepare data requests and negotiate settlement agreements, or, if proceeding to litigation, prepare interrogatories, present witnesses and exhibits, cross-examine witnesses and analyze evidence, litigate before PUC Administrative Law Judges Preparing and filing motions, briefs, exceptions, and other pleadings as necessary for the prosecution of cases

Work Schedule and Additional Information: Full-time employment Work hours are 8:00 AM to 4:30 PM, Monday - Friday, with 60-minute lunch. QUALIFICATIONS Minimum Experience and Training Requirements: Two years of progressively responsible experience in professional legal work which provided exposure to governmental regulatory law (regarding public utilities)/administrative law and graduation from an approved school of law; or Any equivalent combination of experience and training. Additional Requirements: You must have experience in governmental regulatory law and public utilities. You must have possession of a certificate of admission to the Bar of the Supreme Court of Pennsylvania, or be eligiblefor a certificate of admission to the Bar of the Supreme Court of Pennsylvania. You must have possession of a certificate of admission to the bar of the highest court of another state, with preparatory steps taken to become a member of the Bar of the Supreme Court of Pennsylvania. You must be able to perform essential job functions.
